Section 5(a)(1) of the Occupational Safety and Health Act of 1970: For the period of time up to and including November 3, 2008, the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were not protected from the hazard of explosion resulting from employees using blow torches to cut live artillery ammunition shells for scrap metal. Among other methods, one feasible and acceptable abatement method to correct this hazard is to develop and implement a comprehensive scrap inspection program to identify and handle if there are any live ammunitions found. Such program should follow the guidelines of the U.S. Army Ordnance Explosive Disposal (OED) or Alcohol, Tobacco & Firearms (ATF).
