Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm:
At the 3520 NW 135th St, Oklahoma City, Oklahoma worksite:  On or about
February 25,
2009, Tony Holt Construction employees were performing framing operations
from the
following:
a)  Skytrak rough terrain forklift with a work platform that was not
designed per
manufacturer's specifications.  The work platform was without adequate
fall protection,
lacked toeboads and the platform exceeded the width requirements by 128
in. exposing the
employees to fall hazards or caught by the Skytrak tipping over due to the
size of the work
platform.
b)  CAT rough terrain forklift with a work platform that was not designed
per manufacturer's
specifications.  The work platform was without adequate fall protection,
lacked toeboards and
the platform exceeded the width requirements by 43 in. exposing the
employees
to fall
hazards or caught by the CAT tipping over due to the size of the work
platform.
A feasible means of abatement is to construct a work platform meeting the
requirements of
ASME B56.6-2002 Section 8.24.
