Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to falls when walking/working on tops of tractor
trailer tankers:
The employer does not ensure that each employee working from the top of
tractor trailer
tankers with unprotected sides and edges is protected from falling by a
personal fall arrest
system (PFAS) or an appropriate custom-fit guardrail system.  This
violation was observed
on or about February 10, 2009, in the Asphalt Loading Rack area where
process and
contract/visiting product truck operators were not protected from the
hazard of a fall of
approxmimately 10 feet to the concrete surface below.
To abate this violation, the employer must ensure fall protection is
provided for employees
walking/working from the tops of tractor trailers.
