Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: At the 5500 Tinker Diagonal, Del City, Oklahoma worksite: On or about February 26, 2009, Howard Construction employees were cleaning brick from a Skytrak rough terrain forklift with an inadequate work platform exposing the employees to fall hazards of approximately 15 ft. A feasible means of abatement is to construct a work platform meeting the requirements of ASME B56.6-2002 Section 8.24. Written permission from the forklift manufacturer is required by 29 CFR 1926.602(c)(1)(ii).
