Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: West grain storage bin; on or about March 23, 2009, grain cooperative employees were engaged in a soybean storage salvage operation involving the cutting of a hole by a contractor into the metal wall bin with a gasoline powered abrasive wheel saw. The saw ignited combustible soybean debris into a smoldering fire and subsequently a small fire developed. This exposed the employees to the hazards of fire and/or explosion. Among other methods one feasible and acceptable method of abatement would be to prohibit the use of any cutting tool that could ignite the combustible debris.ible
