Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of electric shock while truck drivers attempted to drive an oversize load under energized overhead power lines. At the site on Hwy I-40 east bound, mile marker 26 between Sayre and Elk City, OK: On or about May 1, 2009, and at time prior thereto, Cummins Construction Co., Inc. did not take necessary precautions to prevent employees from contacting with energized overhead power lines directly with any unguarded parts of their body or indirectly through conductive materials, tools, or equipment. As a result an employee working on the ground was seriously injured by an electric shock when the raised bed of a dump truck contacted 14.4 kV overhead power lines. Among other methods, one feasible and acceptable abatement method to correct this hazard is either to contact the utility company for assistance prior to beginning the job or develop and implement the procedures for safely working near energized overhead power lines in accordance with the guidelines or instructions of ANSI A10.47 or NFPA 70E.
