Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazard(s) while working on high elevation. On or about June 24, 2009, and at time prior thereto, in the receiving area employees working in a personnel cage mounted on a forklift truck and raised to a height of 16 feet were provided with the wrong type of fall protection harness systems. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide employees with fall restrain systems in accordance with the guidelines or instructions of ASME/ANSI B56.1 - 1993, Paragraph 7.35.
