Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical in that employees were exposed to struck-by and caught-in-between hazards associated with the assembly of modular buildings: On or about July 21, 2009, and at times prior thereto, the employer allowed the installation of modular building halves without ensuring the structures were securely tied off to a stable object and firmly supported by additional cribbing in soft or wet soil conditions. Employees were exposed to the type of hazards associated with struck-by and caught-in-between. Among others, one feasible and acceptable method of abatement would be to assure the adherence to the Ramtech Building Systems Installation Field Safety Guidelines.
