North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and struck-by hazards: a)Camden Road Trolley Museum construction site, employer operated a Harlo Rough Terrain Forklift, directed and supervised employees to perform work from a personnel platform up to 20' above ground elevations, without having first obtained written approval from the manufacturer to use the attachment, and subsequently make appropriate changes to the capacity plates, decals, tags and operation and maintenance manuals. Reference:The American Society of Mechanical Engineers, Safety Standard for Rough Terrain Forklift Trucks, SME B56.6-2002, Part II, Section 5.2 Modifications, Nameplates and Capacity and Section 5.3 Stability. Among other methods, one feasible and acceptable method to correct these hazards is to obtain written permission from the manufacturer for use of the attachment as a basket/work platform for employees, and make appropriate changes to capacity plates, decals, tags, and operation and maintenance manuals. b)jobsite, the personnel lift basket/platform used in conjunction with the Harlo 6500 Rough Terrain Forklift had not been provided with a rated load capacity. Reference:The American Society of Mechanical Engineers, Safety Standard for Rough Terrain Forklift Trucks, ASME B56.6-2002, Part II, Section 5.15, Elevating Personnel. Reference:The American Society of Mechanical Engineers, Safety Standard for Rough Terrain Forklift Trucks, SME B56.6-2002, Part III, Section 8.5, Nameplates and Markings. Among other methods, one feasible and acceptable method to correct these hazards is to provide a load rated capacity test of the personnel lift platform and affix the maximum capacity to the attachment. c)jobsite, employer authorized the operation of a Harlo Manufactured 6500 Rough Terrain Forklift without the operator's manual available for the operator reference,training or retraining for the particular truck being operated, and the operator's manual prohibited lifting personnel with the lift. Reference:The American Society of Mechanical Engineers, Safety Standard for Rough Terrain Forklift Trucks, SME B56.6-2002, Part II, Section 6.1.4, Operating Safety Rules and Practices. Among other methods, one feasible and acceptable method to correct these hazards is to obtain an operator's manual from Harlo Manufacturer prior to authorizing employees to operate the forklift.
