Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Employees were exposed to struck-by and crushing hazards due to the loss of electrical control of rail mounted Washington Portal (Whirley) Cranes: a). On or about November 14, 2010, employees were exposed to struck-by hazards from a crane hook due to the loss of control of Crane #1A because of a sudden loss of electrical power as the crane and hook were both moving. This created a sudden stop as the boom was swinging. Crane #1A is a rail mounted Washington Portal (Whirley) Crane. b). On or about November 15, 2010, employees were exposed to struck-by and crushing hazards by an oceanic lifeboat after loss of control of the crane due to electrical power failure while it was being moved and lifted by Crane #18, a rail mounted Portal (Whirley) Crane. Feasible and acceptable methods of abatement to correct the hazard include, but are not limited to the following: 1. Conform to ASME B 30.4 Section 4-2.3.3 stating that "any hazardous condition disclosed by the inspection requirements of Section 4-2.1 shall be corrected before operation of the crane is resumed." Repairs or replacements shall be provided as needed for operation. The following are examples... ..."critical parts that are cracked, broken, bent, or excessively worn or corroded." This would include ensuring that the rail to which the Washington Portal (Whirley) Cranes are mounted remain straight and in line. In addition, the pick up shoes and brushes that are needed to complete the electrical circuit to power the cranes would need to be kept in an operable condition or replaced.
