North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by/crushing hazard while operating forklifts: a)facility, forklift trucks were installed with an overhead guard, but seat belts were not worn by forklift operators, exposing them to a struck-by hazard in the event of forklift overturning. Among other methods, one feasible and acceptable method to correct this hazard is to require employees to wear seat belts when operating forklift trucks. Reference: American Society of Mechanical Engineers, Safety Standard for Low Lift and High Lift Trucks, ASME B56.1-1993, paragraph 5.3.19: An active operator protection device or system, when provided, shall be used.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard while securing the load on to a trailer: a)production, no fall protection was provided for the employee who climbed onto the top of concrete wall forms to install cardboard and strapping so that it could be secured to the trailer for shipment. The employee was exposed to a fall hazard of up to 14-feet to the concrete floor below. Among other methods, one feasible and acceptable method to abate this hazard is to ensure that employees not climb onto the load while securing it. The operation could be completed by utilizing an extension ladder to reach the center tie down and securing it.
