T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: In that the rack located in aisle #8 near the P.E.T. door had two uprights which were damaged. The employer did not replace or repair the uprights and was still using the rack to store pallets of cardboard boxes, bottle caps, and bottles. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to replace the damaged uprights. ABATEMENT VERIFICATION REQUIRED
