T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: In that the employees working in the receiving area were exposed to the following hazards: a) Collapse hazard. In that the pallet rack system was not securely attached to the floor and had damage to the structure support members in four instances. b) Amputation hazard. In that employees were using their hands to lift the dock plate's lip. Among other methods, one feasible and acceptable abatement method to correct these hazards is to follow the industry standard: a) Secure frame legs to the floor with anchor bolts and replace damaged structure support members, b) Remove broken dock plates from service until repairs are made.
