Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard in the event of a roll-over. a)3800 Jay Street, N.E. - A laborer was operating a Ditch Witch back-hoe, model number MX272, while driving onto a tilt up trailer, and was not wearing the provided seat belt, on or about 09/19/08. b)3800 Jay Street, N.E. - A laborer was driving a Ditch Witch back-hoe, model MX-272, onto a tilt trailer, which was following a Bob Cat loader, and the trailer leveled out causing the Ditch Witch back-hoe to turn over, injuring the laborer, on or about 09/19/08.
