Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:07/14/08 Location:East Bound Lane of Maryland State Highway 77 Near Old Mills Road Condition:Employees were exposed to being struck by vehicular traffic while working in one lane of a two lane, 40 mph road having an improperly established temporary traffic control work zone: a "flagger" sign was not utilized on the eastbound side roadway where it was required at 800 feet prior to the lane closure and a "One Lane Road 1500 feet" sign was not utilized on the westbound side of the road where required; cones or barriers were not utilized to demarcate the work zone and for a transition area or shifting taper zone for the control of traffic flow as required. Among other methods, one feasible and acceptable means of abatement method to correct the hazard is to establish safe work zones in accordance with Part VI, Temporary Traffic Control, Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000 guidelines. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.

Among other methods, one feasible and acceptable means of abatement method to correct the hazard is to utilize the proper rigging equipment in accordance with American National Standards Institute B30.9-1971, Safety Standards for Cranes, Derricks, Hoists, Hooks, Jacks, and Slings. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.

Among other methods, one feasible and acceptable means of abatement method to correct the hazard is to utilize signaling devices in accordance with Part VI, Temporary Traffic Control, Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000 guidelines. The proposed penalty for this item has been reduced by 50for effective and efficient abatement during the inspection.
