Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)Power Plant 4 at the Maintenance Shop: On October 16, 2008 and at times prior thereto the Nissan forklift, model YJ02, serial number 12203, was not equipped with a seat belt and was operated by employees. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO INSTALL OPERATOR RESTRAINT AS REQUIRED BY ASME B56.1-2000 "SAFETY STANDARD FOR LOW-LIFT AND HIGH- LIFT TRUCKS."
