North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to throw against, struck by and crushed by Roll Over Protection System (ROPS) hazard during tip-over: a)establishment, plant - where an employee was observed operating a Toyota M7P Forklift (Model 42-6FGCU15) that was missing half of the installed seat belt during operation. One feasible and acceptable abatement method, among others, to correct this hazard is to ensure the seatbelt is functional and have operators fasten the seat belt while operating equipment. (Reference: ASME B56-1-1993, Paragraph5.3.19: An active operator protection device or system, when provided, shall be used.)
