North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard of an uncontrolled object being moved. a)jobsite - a hazardous condition existed on 10/16/08 when the operator (foreman) of a John Deere 310SG backhoe/loader failed to ensure employees were a safe distance from a load being repositioned while he operated the equipment, resulting in an injury. b)jobsite - a hazardous condition existed on 10/16/08 when the operator (foreman) of a John Deere 310SG backhoe/loader failed to ensure stability by attaching a hand line while repositioning the load, resulting in an injury. Among others, feasible and effective abatements would be to ensure the operator abides by the caution stated on page 2-2-30 of the John Deere Operator's Manual for the 310SG Backhoe Loader: "Do not allow any persons near the load" and abide by the instruction stated on page 2-2-30 of the John Deere Operator's Manual for the 310SG Backhoe Loader: "2. Attach a hand line to load for stability. "
