North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling to a lower level: a)site-a work basket from which employees were working at a height of approximately 14 feet, was not secured to the forks of a Sky Trak model 8042 to prevent if from fall from the forks. (ref: para 8.24.1(h) ASME B56.6-2002) One feasible means of abatement is to chain the work platform to the frame of the lift mechanism.
