North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed and/or struck by unsecured bales of tobacco: a) Tobacco loading and shipping operation - Transport trucks were loaded with 52 bales of tobacco stacked 13 deep, 2 high and 2 wide without being secured and drivers were responsible for opening the doors at the receiving station. Abatement Notice: One feasible and acceptable means of abatement is to provide load securing devices to prevent bales of tobacco from shifting while in transport.
