North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to thrown against, struck-by, and crushed-by Roll Over Protection System (ROPS) hazards during tip-over: a)facility, throughout - where an employee was observed operating a Kalmar AC fork truck (SN 32150A, Model E50BX EV) without wearing the installed seat belt during operation. ABATEMENT NOTE: One feasible abatement, among others, would be to re-train employees in proper use of seat belts and to require operators to wear the seat belt during forklift operation. (Reference: ASME B56-1-2004 Safety Standard for Low Lift and High Lift Trucks, Paragraph 5.3.19: An active operator protection device or system, when provided, shall be used. Additionally, the Kalmar AC Operator's Manual for E 40-60 BX stated "When operating, make certain the seat belt is correctly fastened.")
