North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in
that employees were exposed to injuries due to the inability to properly
guide a tower crane IAW  47, NSC
Data Sheet 1-630-Reaf.83 :
a)site-employee assigned to control a 15 ton Linden tower crane, was not
properly trained and
was not considered a competent person to direct, via hand controls, for a
lift of steel mesh.
A feasible means of abatement is to train all employees in the use of
proper signals to guide
competently direct cranes.
