North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to throw against, struck by and crushed by hazards from the Roll Over Protection System (ROPS) during tip over: a)facility, throughout - for an employee observed operating a Hyster 80, Model H8FT, SERIAL NUMBER: N0005V05096F forklift truck without wearing the installed safety belt during operation. One feasible abatement method, among others, to correct this hazard is to have operators fasten the seat belt while operating the equipment.
