Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to fall and crushing hazards: a). Route 62 Bridge Project. On or about 08/21/08, an employee raised and extended the boom on a Genie S-85 aerial lift that was not on a firm, level surface as required by the manufacturer. The lift tipped over, seriously injuring the employee. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD WOULD BE TO COMPLY WITH THE MANUFACTURER'S OPERATOR'S MANUAL AND THE INSTRUCTIONS POSTED AT THE OPERATOR'S CONTROLS THAT PROHIBIT RAISING OR EXTENDING THE BOOM UNLESS THE MACHINE IS ON A FIRM, LEVEL SURFACE. NO ABATEMENT CERTIFICATION REQUIRED b). Route 62 Bridge Project. On or about 08/21/08, an employee operating a Genie S- 85 aerial lift relied upon the tilt alarm as a level indicator. The lift tipped over, seriously injuring the employee. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD WOULD BE TO COMPLY WITH THE MANUFACTURES OPERATOR'S MANUAL AND THE INSTRUCTIONS POSTED AT THE OPERATOR'S CONTROLS THAT PROHIBIT DEPENDING ON THE TILT ALARM AS A LEVEL INDICATOR. NO ABATEMENT CERTIFICATION REQUIRED
