Section 5(a) (1) of the Occupational Safety and Health Act of 1970: the
employer did not
furnish to each of his employees and a place of employment which was free
from recognized
hazards that were causing or likely to cause death or serious physical
harm to employees in
that employees were exposed to hazard of being struck while working in
close proximity to a
backhoe.
Venable's Construction, 2.2 Miles N. of FM 283 on Payne Ranch Road and 0.8
Miles N E
of Payne Ranch road on a Lease Road, Miami, Texas. For the period of time
up to and
including January 27, 2009, an employee was required to work in a
hazardous situation when
he was elevated at approximately 3 feet in a Caterpillar back hoe bucket
to reach the top
section of metal joists on a truck trailer. The employee attached
stringing hooks at one end of
the metal joists.
Among other methods one method would have been to use a forklift with a
personnel
basket
to elevate the employee to the top of the pipes.
