Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being crushed by free standing steel pilings. At the construction site, 200 North End Avenue, New York, NY 10282-1233 On or about 08/12/08 An employee was exposed to the uncontrolled toppling of free standing sections of steel pilings 19 feet long x 14" diameter round steel pilings that were cut to the required elevation. Among other methods, feasible and acceptable methods to correct this hazard is to: a) Secure the piling using rigging and a crane/excavator and remove each piling after it is cut by using the crane/excavator. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT CERTIFICATION OF ABATEMENT FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
