Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from a defective ladder: (a) In the yard, employees used a portable fiberglass stepladder that had a broken rung to gain access to a freight storage container. Among other methods, one feasible method of abatement is to check frequently hardware, fittings, and accessories, and remove ladders from service when damaged as described in ANSI A14.5-2000 American National Standard for Ladders - Portable Reinforced Plastic - Safety Requirements, Sections 9.4.1 Inspection, 9.4.2 Damaged Ladders, and 9.4.6 Maintenance.
