Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries: (a)Muhlenburg Middle School, Laureldale, PA - An employee was observed riding outside the cab of the John Deere 410G backhoe loader, thereby exposing the employee to falling and being crushed by moving equipment, on or about October 23, 2009. ABATEMENT NOTE: One feasible means, among other methods is to forbid riders on the equipment. Only the seated operator shall be allowed on the machine. VERIFICATION REQUIRED
