Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees n that employees were exposed to potential crushing injuries from a falling load while using inadequately engineered lifting devices. (a)Battery Charging Area - Employees used an unlabeled lifting device to lift powered industrial truck batteries. The employer did not insure that the lifting device was marked with its rated capacity, manufacturer information and serial number, on or about March 8, 2010.
