North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to falls from elevation:
a)production, WP model personnel work platform, the lanyard
of the fall arrest systems was tethered to the top rail
of the personnel lift basket and not to an approved
attachment point.
Reference:  Owners Manual, Work Platform, Model WP, WP-
3737-FD and SP-175.  Warnings and Safety Instructions:
Warnings:  "Each person aboard the work platform must
wear appropriate fall prevention gear and keep it
tethered to the platform at the lanyard attachment point
at all times".  "Do not use any part of the gate, side
rails, or safety chains as a step, or as a support for
leaning out of the work platform".  Under Operation and
Use warning:  "Do not lean against the handrails or
safety chains to support the weight of your body.  Latch
your safety harness rope to an attachment slot on either
end of the angle that runs across the back of the
platform".
Among other methods, one feasible and acceptable method
to abate this hazard is to provide have the manufacturer
provide an attachment point that is approved to withstand
the forces of a fall.
