Section 6(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to fall from about 17 feet above the floor:

the fact that only one hazard is covered by them rather than penalizing

On March 10, 2009 Four Star Aviation Inc (Four Star Air Cargo), Luis Munoz
Rivera Airport Building #2, Carolina,  employees were observed exposed to
fall
hazard.  A Fork lift was observed lowering from the roof two employees
standing
on a platform made out of four wood pallets.  The roof stood 17 feet above
the
lower level.  The employees escorted an air-conditioning company employee.
Since the forklift did not reach the roof it was necessary for them to use
the four wood
pallets.
ABATEMENT NOTES: Among other methods, two feasible methods to reduce
this hazard are:
1. Providing a ladder.
2. Use an approved cage to lift employees safely.
Alternativa:  Las Normas  4 OSH 1910.(a)(4): y la Seccion 6a.0001 (numero
de citacion 01
articulo 01) son citadas en la alternativa debido a su equivalencia; en
respuesta a su equivalencia
y a que estas cubren un solo riesgo, en lugar de penalizar por cada una de
ellas, solo se multa
una vez por las Normas citadas en la alternativa.
El 10 de marzo del 2009 en Four Star Aviation Inc (Four Star Air Cargo),
Aeropuerto Luis Munoz Marin, Carga Area, Edificio #2, Carolina se
observaron
empleados expuestos en riesgo de caida. Se observo un montacargas bajando
de
un techo a dos empleados que estaban parados sobre una plataforma hecha de
cuatro paletas.  El techo estaba a 17 pies sobre el nivel inferior.  Los
empleados
escoltaban a un empleado de una compania de aires acondicionados.
Como el montacargas no alcanzaba el techo, fue necesario para ellos
utilizar cuatro
paletas de madera.
NOTAS PARA CORRECCI:N:  Entre otros metodos, dos metodos factibles para
reducir este
peligro son:
1. Proveyendo una escalera.
2. Usando un cajon aprobado para elevar a los empleados.

At Four Star Aviation Inc.(PR), the employer did not have a written
protocol
to handle domestic violence in the workplace, as required by the Act for
the
Implementation of a Protocol to Handle Domestic Violence Situations in the
Workplace or Place of Employment, Act No. 217 of 2006.
Method to abate the hazard: Develop a written protocol to handle domestic
violence in the workplace and provide training to all the employees.

during the inspection.
Hazard: Fatalities, injuries, and illnesses related to domestic violence
in the
workplace.
En Four Star Aviation Inc., el patrono no tenia un protocolo escrito para
manejar situaciones de violencia domestica en el sitio de trabajo, como lo
requiere la Ley para la Implementacion del Protocolo para Manejar
Situaciones
de Violencia Domestica en el Sitio de Trabajo, Ley Num. 217 del 2006.
Metodo de corregir el riesgo: Desarrollar un protocolo escrito para el
manejo
de la violencia domestica en el sitio de trabajo y proveer adiestramiento a
todos los empleados. Hay informacion disponible en la Oficina de la
Procuradora de la Mujer, Una Guia para Patronos: Violencia Domestica en el
Sitio de Trabajo, y otras referencias provistas durante la inspeccion.
Riesgo: Fatalidades, lesiones, y enfermedades relacionadas a la violencia
