Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a) At various jobsites, on or about August 25, 2008 and prior to that
time, crane operator(s)
and/or labor employee(s) performing form bundle rigging, lift basket
rigging and crane boom
operations were exposed to potential struck-by and/or crushing hazards
from disengaged boom
sections, lift baskets, form bundles and/or falls from the operator's
control station due to a
cracked or split boom section on a PM 32 series articulating knuckle boom
hydraulic truck
crane.
Among other methods one feasible and acceptable method to correct this
hazard would be to
follow ANSI B30.22-2005, Adjustments and Repairs section 22-2.3.3(c)(2),
which
includes, but
is not limited to: "Repairs or replacement...of critical parts of the
crane structure, which are
cracked, bent, broken, or excessively corroded...," be provided as needed
for safe operation..,"
