Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a struck by hazard from the steel storage racks system
having the following
deficiencies:
a) Regular inspections for damage was not conducted. When visible damaged
on the some of the
uprights and base plates of the steel storage racks of aisle FH was found,
damaged columns and
base plates were not repaired immediately, on or about 10/29/08.
b) Plaques indicating the maximum permissible unit load and/or maximum
uniformly distributed
load per level and the maximum total load per bay were not posted on any
of the steel storage
racks aisles, on or about 10/29/08.
c) Base plates were missing from some of the columns on aisles NF and FH,
on
or about
10/29/08.
d) The steel storage rack, aisle NF, where vehicle batteries were stored
may have been
overloaded, on or about 10/27/08
Among other methods, one feasible and acceptable method to correct this
hazard is to follow the
User Manual for Interlake's Storage Rack Products and the ANSI standard
MH16.1-2008.
In accordance with 29 CFR 1903.19(c), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
