Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about Wednesday November 5, 2008 at 5430 North Henry Blvd Stockbridge, GA 30281 the employer did not furnish his employees a place of employment which was free from fall hazards approximately 16 feet above the ground level. An employee was observed working from the forks on a JCB (Model 506C) Rough Terrain Forklift without fall protection at approximately 16 feet above ground level. No abatement certification or documentation is required for this item.
