Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck sharp pieces. On or about June 15, 2009: (a)PVC pipe was being used to transport compressed air used to apply adhesive in hot melt and spray applications. Among other methods, one feasible and acceptable abatement method to correct this hazard as recommended by the Plastic Pipe Institute is that the pipe be buried, encased in shatter resistant material, or replaced with metal (copper or iron) pipe. (See Plastic Pipe Institute Recommendation B Thermoplastic Piping for the Transport of Compressed Air or Other Compressed Gases (2005)). In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
