Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that forklift
operators were exposed to struck-by and crush hazards when being thrown
out of the vehicle in
case of collision or tip over.
On or about 06/17/09:
a) Plant - Employees operated the 120 Hyster XL2 No 8 forklift without a
seatbelt installed in
the vehicle.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to require and ensure that employees utilize the operator restraint system
(seat belt) as required
by ANSI B56.1 consensus standard for powered industrial trucks, and ASME
B56.1 2000-Safety
Standard for Low Lift and High Lift Trucks.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition,
documentation demonstrating that abatement is complete must be included
with your
certification.  This documentation may include, but is not limited to,
evidence of the purchase
or repair of the equipment, photographic or video evidence of abatement,
or other written
records.
