Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to combustible and toxic chemicals: a) Bulk tank farm - The employer did not develop a standard operation procedure for the transfer of N-methyl pyrrolidone from a 5000 G vertical vessel to a 3000 G horizontal vessel. A valve was left in the open position and the horizontal tank overflew, creating a chemical spill of the combustible and toxic solvent. AMONG OTHER METHODS, FEASIBLE ABATEMENT METHODS TO CORRECT THESE HAZARDS WOULD BE (BUT WOULD NOT BE LIMITED TO): 1) Preparation and implementation of standard operation procedures describing the sequence of steps to follow, and training of employees in relation to such procedures. (Reference: "Guidelines for Process Safety Documentation", Center for Chemical Process Safety, American Institute of Chemical Engineers, Pub No G-27) 2) Installation of instrumentation for level indication, control, and alarms. (Reference: Guidelines for Hazard Evaluation Procedures with Worked Examples, Center for Chemical Process Safety, American Institute of Chemical Engineers, Pub No G-18) In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRETIVE ACTION WORKSHEET).ON
