Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazard while placing items onto and off metal racks: a)Employees were exposed to struck by hazards, while placing items onto and off metal racks. The employer failed to anchor all rack columns to the floor with anchor bolts and/or replace damaged racks on or about September 18, 2009. Among other methods, one feasible and acceptable method to correct this hazards is the become familiar with the requirements for the use of steel storage racks as written in ANSI MH16.1- 2008 or follow manufacturer's recommendations. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
