Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by pieces of PVC pipe. On or about 11/19/2009: a) Sanding area - PVC pipe was being used to transport compressed air used in the sanding stations. Among other methods, one feasible and acceptable abatement method to correct this hazard is to get the pipe buried, encased in shatter-resistant material, or replaced with approved plastic (HDPE, ABS), or metal (copper or steel) pipe. (See Plastics Institute Recommendation B - Thermoplastic Piping for the Transport of Compressed Air or Other Compressed Gases, 2005. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
