Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a) On October 27, 2009, employees were installing a metal roofing system
on a low-slope
roof, using a Genie GS-2032 scissor lift to access roof. The employees
were climbing
over the top and midrails of the Genie GS-2032 to access the roof top,
exposing them to
a fall hazard of approximately twenty (20) feet from the scissors lift
railing to the
ground.
Among other methods, feasible and acceptable means to correct these hazards
are to use other equipment with which to access the roof, or to ensure the
Genie GS-2032 scissor lift is operated according to the Genie Operator's
Manual and acceptable requirements of the approved American National
Standards for Self-Propelled Elevating Work Platforms ANSI/SIA A92.6-
2006, Section 7 Responsibilities of User, and other acceptable industry
practices. The ANSI consensus standard requires the following:
7.10Operator warning and instructions.
(9) Personnel footing. Personnel shall maintain a firm footing on the
platform floor while working thereon. Climbing by occupants on the
midrails or toprails of the aerial platform is prohibited. The use of
planks, ladders, or any other devices on the platform for achieving
additional height or reach is prohibited.
