Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to multiple injuries and or death from falls or struck by
hazards created by using
an inappropriate personnel work platform attached to a rough terrain
forklift truck or use of
malfunctioning R&P.
a)One employee was exposed to a fall hazard created by performing sheeting
work from
an elevated work platform attached to a Sky Trak 6036 Legacy Series rough
terrain
forklift truck; the rough terrain forklift truck did not have a working
horn, the platform
was not marked with a workload or empty weight marking placard and had
floor
dimensions greater than the overall width of the truck (measured across
load bearing tires
plus 10 in); additionally, the platform did not have a means to only be
centered
laterally,
did not have upper guardrail with midrail completely around to secure
personnel, and a
toe plate.
Among other methods, feasible and acceptable abatement methods to correct
this hazard are to
ensure the rough terrain forklift truck is properly maintained and the
work platform is designed
and constructed according to the acceptable requirements of the approved
American National
Standard, Safety Standard for Rough Terrain Forklift Trucks, ASME
B56.6-2002, Part II Section
5.13 Warning Device and Part III Section 8.24 Platforms for Elevating
Personnel, and other
acceptable industry practices.  The ASME consensus standard requires the
following:
(1) Section 5.13.1Every rough terrain forklift truck shall be equipped
with an operator-
controlled horn, whistle, gong, or other sound-producing device(s).  The
user shall see that all warning devices are in place and in working order.
(2) Section 8.24.1Design requirements for the manufacture of the platform
shall include the
following:
(b)floor dimensions shall not have a width greater than the overall
width of the truck [measured across the load bearing tires plus 10
in. (250mm) on either side];
(c)a 4 in. (100 mm) minimum height toe plate which may be omitted
at the access opening;
(f)information prominently indicated on the platform:  (1)  maximum
work load including personnel and equipment; (2)  weight of
empty platform;
(g)means so that the platform can only be centered laterally on the
rough terrain forklift truck and retained against the vertical face of
the forks, carriage, or lifting mechanism;
(l)restraining means such as a guardrail or a means for securing
personnel such as a body belt or lanyard.  A guardrail or similar
structure shall have a nominal height to the platform floor of 42 in.
(1066 mm) around its upper periphery and include a midrail.
