Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:  Fall from height due to tip over of forklift.
a) On 06/14/10, employees were removing shingles from a porch awning onto
a personnel
platform attached to a Skytrak RT forklift.  The platform was not
constructed in
accordance with ANSI B56.6, since it did not have a slip resistant working
surface and
4' toe boards, and was not labled for capacity, weight, and manufacturer.
The estimated
weight of the load on the forklift exceeded 30of the load chart
capacity.
Among other methods, feasible and acceptable means to correct these
hazards is to
fabricate or purchase a personnel platform the meets the requirements
described in ANSI
B56.6-2005, section 8.24, Platforms for Elevating Personnel, and to
provide training to
the operator on ANSI B56.6-2005, section 5.15, Elevating Personnel.
