Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to multiple injuries and/or death created by falls/tip over
from an improperly used
basket on a rough terrain fork lift:
a)An employees was exposed to a fall hazard when entering and exiting the
roof
onto a Highlander rough terrain forklift basket, over 14 feet from ground
level,
by climbing over the railing without any fall protection.
b)Employees were exposed to a fall/tip over hazard when using a basket
that was
not marked with a workload and empty weight marking.
c)Employees were exposed to a fall/tip over hazard when using a platform
with floor
dimensions greater than the overall width of the truck (measured across
the
load bearing
tires plus 10 inches on either side.)
Among other methods, feasible and acceptable abatement methods to correct
this hazard would
be to use a ladder for access or ensure the work platform is designed and
constructed according
to the acceptable requirements of the American National Standard
Institute/Industrial Truck
Standards Development Foundation, ANSI/ITSFD B56.6-2005, Part II, Section
5.15.1(w) for
elevating personnel and Part III, Sections 8.24.1(b) and (f) Design and
construction standards
for platforms elevating personnel. The ANSI/ITSFD B56.6 consensus standard
requires the
following:
Section 5.15.1(w): The platform shall be lowered to floor level for
personnel to enter and exit.
Personnel shall not climb on any part of the rough terrain forklift truck
in attempting to enter
and exit.
Section 8.24.1(b): Floor dimensions shall not have a width greater than
the overall width of the
truck (measured across the load bearing tires plus 10 inches.
Section 8.24.1(f)(1): Information prominently indicated on the platform
the maximum work load
including personnel and equipment.
Section 8.24.1(f)(2): Information prominently indicated on the platform
the weight of the empty
platform.
Abatement Certification and Abatement Documentation required.
