Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fall hazards from a scissor lift platform:
a)On November 22, 2010 a scissors lift (JLG 1930ES) was being used with
the platform
being elevated to approximately 15' above the cement floor without the mid
rail chain
attached on the access opening to the platform, exposing the operator to a
fall from the
lift.
Among other methods, feasible and acceptable means to correct the hazard
are to ensure
the scissor lift is operated according to the Operator's manual and
appropriate sections
of theAmerican National Standards for Self-propelled Elevating Work
Platforms (ANSI
A92.6-2006). Section 7.10.4 states that guardrails shall be installed and
positioned, and
access gates or openings shall be closed per the manufacturer's
instructions. Section
8.8.2 states that prior to each elevation the operator shall ensure
guardrails are installed
and access gates or openings are closed per the manufacturer's
instructions.
