Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a fall and struck-by hazards from a scissor lift(s) being
tipped over.
a)The employer did not implement practices to prevent collisions between
scissors lifts and
lift trucks operating in the same area on 12/2/10.
Feasible abatement could include using the procedures out lined in the
American National
Standard for Self-Propelled Elevating Work Platforms ANSI/SIA A92.6-2006.
7.10 Operators warnings and instructions.
(10) Precaution for other moving equipment. When other moving equipment and
vehicles are present, special precautions shall be taken to comply with
local
ordinances or safety standards established for the workplace. Warnings
such
as,
but not limited to, flags, roped off areas, flashing lights, and
barricades shall be
used as appropriate.

Feasible abatement could include using the procedures outlined in the
Companies March
21, 2007 "Lessons Learned" memo written following an incident on 3/21/07,
where an
employee was seriously injured.  The memo states "Mark off the area with
safety cones
or yellow caution tape". That suggestion was not incorporated into the
company Safety
Policy & Procedures for Aerial Personnel Lifts. (2nd revision issue date:
1/2005)
