Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fall hazards relating to the use of a personnel platform
on a Skytrak 3606:
a)On 12/03/2010, employees of Spiegl Construction Co. were working
approximately 12' above the ground while on a 24' long personnel platform
attached to a Skytrak 3606 while installing steel siding.  This platform
extended
more than 10" beyond the Lift truck wheel base on each side.
b)Guardrails were not installed on either end of the platform.
c)The lift truck did not have an operator at the controls while personnel
were
elevated on the platform, and the wheels of the lift truck were not
chocked while
it was parked on an incline.
Among other methods, feasible and acceptable means to correct this hazard
include:
A)Understand and follow the instructions in the Skytrak 3606 Operator's
Manual
(Rev.11/99, Pgs 76-78), Elevating Personnel.
This vehicle is designed to lift and transport materials and in many cases
should
not be used to elevate personnel.  Only equipment designed and approved for
elevating personnel should be used.  If the vehicle must be used to elevate
personnel, use only an approved work platform.  When using a work platform,
the following precautions must be met:
A trained operator must operate the controls from the operator's
compartment and
must remain with the vehicle at all times.
The combined mass of the platform, load and personnel shall not exceed 1/3
of
the capacity of the related load center position indicated on the capacity
chart.
Important! Do not use unapproved attachments.
B)Understand and follow the ANSI Safety Standard for Rough Terrain Forklift
Trucks, B56.6-2005, sections 5.15 Elevating Personnel, and 8.24 Platforms
for
Elevating Personnel:
5.15.1: A rough terrain forklift truck shall not be used to lift people
unless there is no other practical option.  If a rough terrain forklift
truck
must be used to lift people, the following precautions shall be taken:
(a) provide a personnel platform which complies with the design
requirements listed in part III of this Standard (8.24).(s) a trained
operator shall be in position to control the rough terrain
forklift truck, or available to operate controls if the platform is not
equipped with controls. When the operator is not in the operating position,
block the truck wheels and apply the parking brake with all travel controls
in neutral.
8.24.1 Design requirements for the manufacture of the platform shall
include the following:
(b) floor dimensions...shall not have a width greater than the overall
width
of the truck (measured across the load bearing tires plus 10" on either
side).
(f) information prominently indicated on the platform:
(1) maximum work load including personnel and equipment;
(2) weight of empty platform.
(l) restraining means such as a guardrail or a restraining means such as a
lanyard.
