Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were allowed to enter the boom radius of a Liebherr 932 Material handler
Crane without the
crane operator's knowledge, which exposed the employee to struck by
hazards of a load in
motion or the crane parts themselves:
a)  Mechanics placing scrap material generated in their work stations into
the designated
scrap pile used a pathway that entered the swing radius of the Liebherr
932 Material
Handler.
Among other methods, feasible and acceptable means to correct this hazard
include establishing
a zone around the material handler crane following the requirements of
ASME B30.25-2007,
Scrap and Material Handlers - Safety Standards for Cableways, Cranes,
Derricks,
Hoists,
Hooks, Jacks and Slings requires that the operator verify that all persons
are clear of the swing
radius of the handler, or follow the operator's manual which requires the
material handler
operator to be certain that the area surrounding the excavator is free of
other personnel.
A written program and training should be established for employees with
work tasks inside the
boom radius or near the material handler crane regarding the zone around
the material handler,
how it is identified, approved reasons to enter this zone and methods to
notify the handler
operator of an employee needing to enter the zone.
Abatement Documentation and Abatement Certification required.
