Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to multiple injuries and or death from falls created by the
improper use of a self
propelled elevating work platform:
a)One employee who was performing demolition work on a wall was exposed to
the
hazard of falling from an elevation while working in a slightly bent
forward
standing position with the right foot on a Genie GS-3246 scissor lift
platform
midrail and left foot on the top of an uneven, broken, brick, exterior
wall outside
the platform guardrails at a height greater than twenty (20) feet above a
concrete
surface located at 300 S Pearl Street in Marinette, Wisconsin.
b)Two employees were exposed to multiple injuries while performing
demolition
work on a wall from a Genie GS-3246 scissor lift platform at a height
greater
than twenty (20) feet above a concrete surface with a malfunctioning
pothole
safety device and demolition debris inside the base of the lift and on the
platform
work surface located at 300 S Pearl Street in Marinette, Wisconsin.
Among other methods, feasible and acceptable abatement methods to correct
these hazards are
to ensure conformance to good safety practices for the use and operation
of self-propelled
elevating work platforms is used according to the acceptable requirements
of the approved
American National Standard for Self-Propelled Elevating Work Platforms
ANSI/SIA A92.6 -
2006, Section 7, Responsibilities of Users, Genie A Terex Company
Operator's Manual GS-
3246, and other acceptable industry practices.
The ANSI consensus standard requires the following:
7.3.3 Prestart inspection.  Before use each day or at the beginning of
each shift, the
aerial platform shall be given a visual inspection and functional test
including but not
limited to the following:
(2)   Safety Devices
(7)   Placard, warnings, control markings, and operating manuals(s).
7.7   Familiarization before use.  the user shall permit only properly
trained personnel
to operate an aerial platform.  The user shall ensure that before use the
operator is
familiar with the model of the aerial platform to be operated, and
specifically:
(2)   knows the operating and maintenance manuals supplied by the
manufacturer
(remanufacturer) are stored in the weather resistant compartment and is
familiar
with the operating and safety manuals.
(4)   is aware of and understands all safety devices specific to the model
aerial
platform being used.
7.10  Operator warnings and instructions.  Instruction and guidelines
regarding proper
operation shall include, but not necessarily be limited to the following
issues and
subjects:(9)   Personnel footing.  Personnel shall maintain a firm footing
on the platform
floor while working thereon.  Climbing by occupants on the midrail or
toprail of
the aerial platform is prohibited.
(11)  Reporting problems or malfunctions.  The user shall direct the
operator to
immediately report to a supervisor any problem(s) or malfunction(s) that
become
evident during operation.  The user shall ensure all problems and
malfunctions
are repaired prior to continued use.
(28)  Vacating (or entering) an elevated aerial platform.  If permitted by
the
manufacturer, personnel shall only vacate or enter a raised aerial
platform by
following the guidelines and instructions provided by the manufacturer
(remanufacturer).
The Genie Operator's Manual requires the following:

Keep the platform floor clear of debris.
Do not sit, stand or climb on the platform guard rails.  Maintain a firm
footing
on the platform floor at all times.
Do not enter or exit the platform unless the machine is in the stowed
position.

Do not use a damaged or malfunctioning machine.

A malfunctioning machine must never be used.  If malfunctions are
discovered,
the machine must be tagged and removed from service.
