North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to being caught between a scissor lift and overhead (stationary)
structures:
a)production area, On August 12, 2008, an
UpRight SL-14 scissor lift was utilized
without adequate clearance from overhead
obstructions which resulted in an employee
being caught between the lift, natural gas
pipe, and ceiling joist.
b)production area, UpRight SL-14 scissor lift,
the employer did not ensure that employees
were properly trained to operate aerial lift.
c)production area, UpRight SL-14 scissor lift,
the employer did not ensure that frequent,
annual, and prestart inspections of scissor
lift were conducted.
NOTE:Among other methods, one feasible and acceptable method
to abate this hazard is to comply with the provisions as
outlined in the following:
1-  Manual of Responsibilities for Dealers, Owners,
Users, Operators, Lessors and Lessees of ANSI/SIA A92.6-
1990 Self-Propelled Elevating Work Platforms
2-  UpRight SL-14 Safety Rules and Operating
