T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: The employer did not ensure that the automobile lifts in the North Bay were in the proper operating condition such as lift #1 had one load holding device that was not operational and lift # 3 had one load holding device that was not operational. An inspection would have brought these deficiencies to the employer's attention. Among other methods one feasible and acceptable abatement method to correct this hazard is to conform to the American National Standards Institute/Automotive Lift Institute Standard for Automotive Lift Safety requirements for operation, inspection, and maintenance, ANSI/ALI ALOIM-1994.
